Kim Davis, who is an elected official in Rowan County in the state, said to do so conflicts with her Christian beliefs. Earlier this year, the Supreme Court ruled that same-sex marriage is a legal right across the United States. As a result of the ruling, the states which had placed bans on such marriages were no longer allowed to enforce them.
Last week, she refused a request from a judge to allow her clerks to issue licences and therefore was denied an opportunity to be released from jail. While some of Davis's deputies have now started processing licences, there is uncertainty over whether they are actually valid, as they require a signature of an elected clerk. In this case, it is Davis.
It is thought Davis could remain in jail for up to a week.
She has received support from a number of politicians and members of the community for standing up for her beliefs, but others have said that as an elected official, she must carry out her duty and comply with the law.
