Wayne was three times over the legal alcohol limit when he was pulled over by police while driving in September with party girl Laura Simpson.
The Everton striker met her on a night out in Cheshire and he was giving her a lift home on the night they allegedly "kissed and cuddled". Coleen was pregnant at the time.
